Cole Thomas Allen waived his right Thursday to challenge his detention in prison on charges of attempting to assassinate President Donald Trump at last weekend’s White House Correspondents’ Association dinner.

Allen’s waiver was a reversal of the defense team’s intention to challenge his detention, which was expressed in a petition filed with the court on Wednesday night.

“He is accepting custody at this time,” Allen’s attorney Tejira Abe told Magistrate Judge Moxila Upadhyaya during a hearing Thursday in the U.S. District Court for the District of Columbia.

US Attorney Jeanine Pirro’s office, in a petition filed in court on Wednesday, had urged Upadhyay to keep the 31-year-old California resident held without bond pending trial.
