The lawsuit alleges that customers were charged two out-of-network fees for balance inquiry requests, while FCTI, Inc., located in 7-Eleven stores. According to the agreement, customers who may be eligible for the payments used FCTI-owned ATMs within 7-Eleven stores from May 1, 2018, to November 16, 2021. According to the settlement website, Bank of America and the plaintiffs opted for the settlement “to avoid the costs and litigation of ongoing litigation.”
Bank of America denied any wrongdoing in the agreement.
Who is eligible for payment in Bank of America settlement?
Eligible for payment from the settlement are U.S. customers who had Bank of America checking accounts and were assessed more than one out-of-network balance inquiry fee during the same visit to an FCTI-owned ATM located at a 7-Eleven store from May 1, 2018, through November 16, 2021 — and did not receive payment from the claim as a result of an earlier settlement in the Weiss v. FCTI case, which was settled in 2024.
